What is Patent Preparation?

Optional Patentability Report

As an initial matter, for independent inventors or start-up companies, we normally recommend obtaining a third-party patentability report from one of our vendors. A patentability report shows the landscape with regards to the current state of the relevant technological art and allows the applicant to make an informed decision on whether to move forward with the drafting and filing of a U.S. provisional or nonprovisional patent application. Based on the third-party patentability report, we provide an opinion on potential patentable subject matter and how to move forward. This initial process normally requires approximately 1-2 weeks to complete.

How we prepare U.S. patent applications

We prepare U.S. patent applications with as much input from the inventors as possible. The patent application’s Title, Abstract, Specification, Drawings and Claims can all be created based on an invention disclosure document and/or a video conference with the inventors. We do, however, prefer to also include a series of intermediary steps prior to sending you a full draft patent application. Specifically, after the initial video conference, we would send a draft set of claims for your review and feedback prior to preparing the draft patent application. This process normally requires approximately 1-2 months to complete.

Filing of the approved U.S. patent application

Next, after you are completely satisfied with the draft patent application, we will prepare and file the appropriate forms with the U.S. Patent & Trademark Office (USPTO), along with the approved draft patent application. We also can file the U.S. patent application with a PCT request if international patent coverage is desired. As required by USPTO ethics rules, we will promptly forward the filing receipt to you and keep you apprised of further developments, as they occur. This process normally can be completed in 1-2 days.
